MY GOA VILLAS – TERMS & CONDITIONS

My Goa Villas is a trading name of Electra Impex Pvt Ltd, registered in Goa, India. Our registered address is: Amado Villas, Villa D5, Survey No. 216/57, 217/1 Assagao 403516.

Except where otherwise specified, Electra Impex Pvt ltd t/a My Goa Villas (“we”, “us”, “our”) act only as an agent in respect of all bookings we take and/or make on your behalf.

We accept no liability in relation to any contract you enter into or for any services or arrangements you purchase (“arrangements”) or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any arrangements. For all arrangements, your contract will be with the supplier of the arrangements in question (the “supplier(s)”). When making your booking we will arrange for you to enter into a contract with the applicable supplier(s) of the arrangements. Your booking with us is subject to these Agency Terms and Conditions and the specific booking conditions of the relevant supplier(s) you contract with and you are advised to read both carefully prior to booking. The supplier’s terms and conditions may limit and/or exclude the supplier’s liability to you. Copies of applicable conditions are available on request from us.

You may decide to make one or more bookings with us at the same time. The price charged in total for more than one booking will always equal the prices charged separately for each individual booking. All arrangements are available to be purchased separately at the same price, as they are when more than one booking is made.

By making a booking with us you agree that:

  • a) You are authorised to agree the Booking Conditions on behalf of all persons included on the Booking Form
  •  
  • b) You have read these Agency Terms and Conditions and agree to be bound by them on behalf of all members of your party;

  • c) You are over 18 years of age

ACCEPTANCE OF TERMS & CONDITIONS

When you make your reservation, a binding agreement, which states the terms and conditions concerning this rental between you the Guest and Us. Your deposit payment constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed below.

BOOKING PROCEDURE AND PAYMENT:

Once you have decided upon the property you wish to rent, please fill and submit the on-line enquiry form. We will get back to you on the availability of accommodation.

In order to confirm this booking, you must pay 100% of the rental amount at once.

We will provisionally hold the property chosen by you for forty-eight hours from the date of your reservation for the booking form and payment to reach us. If we do not receive payment within stipulated time, we will automatically release your reservation.

On receipt of the full amount, we will send you a Villa booking confirmation.

Please check all details of the Booking Confirmation carefully and report any incorrect or missing information to us immediately. We have no responsibility for any errors in documentation, except where the error has been made by us.

Please Note: For reasons of security and privacy, we do not issue the addresses of any of the private villas which we advertise until you pay the balance of your chosen arrangements in full. Upon receipt of the final balance payment, full directions and arrival instructions for the property shall be provided.

CHARGES AND CANCELLATION BY YOU:

Any cancellation or amendment request must be sent to us in writing by email and will take effect on the day we receive it. You are advised to also confirm all changes to us by telephone.

Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments and cancellations can only be accepted in accordance with the terms and conditions.

Following are the cancellation charges, which we provide for your information:

  • a) Cancellation period Forfeit.
  •  
  • b) Cancellation more than 70 days before the start of the holiday 30% deposit only.
  •  
  • c) Cancellation between 36 – 69 days 50% of total holiday cost
  •  
  • d) Cancellation 35 days before the start the holiday 100% of the total holiday cost.

BREAKAGES DEPOSITS

At the time of Check-in a security damage deposit of Rs. 20000/- or equivalent to one night rental whichever is higher to be handed over to Villa Manager, refundable on Check-out provided there is no damage to the property and all due bills are cleared. In the event that you, the Guest, has failed to report and paid for such damage and/or outstanding bills, you hereby give your approval and consent us to charge the amount to you (the Guest’s).

You as the Guest agree to take the responsibility to ensure that your family and other guests in your party adhere to the rules and regulations affecting the villa. The Villa is fully furnished, including an ample supply of towels for Guest’s use. All normal utilities are included in your rental price. Locked pantries and closets are reserved for the use of staff and are not included in this rental. Rearranging the furniture or removing any items from the villa is prohibited. You hereby agree to pay us for any breakage, damage, missing items, replacement costs for all damages to personal property or to the real estate, charges incurred before, during or after your stay which may occur as a result of your occupancy, excluding normal wear and tear.

PRICES

We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices.

Special note: changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking.

You agree that any charges incurred by us for receiving payments will be borne by yourself.

IDENTITY OF THE GUEST:

We will ask you to send us a copy of a document that matches your official identity and to confirm us the total number of persons who will stay in the house.

CAPACITY OF THE VILLA:

The total number of persons allowed to sleep in the Villa at any one time is restricted to the number of persons scheduled and paid for.

CHECK-IN AND CHECK-OUT TIME:

To facilitate a smooth and comfortable transition for the arrival and departure of our guests, we have fixed the arrival as 2:00 PM and departure timing as 11:00 AM.

Changes to these times can be requested prior to arrival where there are no other guests arriving or departing the same day, but are subject to confirmation and payment of any applicable increase in price.

ENTRY INTO THE VILLA:

Staff and maids reserve the right to enter the property to perform their duties such as maid service and any repairs necessary. We will make every effort to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your stay.

DRUGS AND HAZARDOUS MATERIALS:

Guest and members of his party shall not use or permit to be brought into the Villa any illegal substances, inflammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property.

No firearms or illegal substances are allowed at the villa.

VILLA AGREEMENT:

Unregistered guests are not permitted to stay overnight at the villa. For every unregistered guest we will charge Rs.15.000/- per night.

INSURANCE

You are strongly recommended to take out personal travel insurance for all members of your party. Some suppliers require that you do so. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday.

COMPLAINTS & MAINTENANCE

We shall make every effort to keep the Villa and their inventories in good working order. In case of a maintenance problem, we will strive to repair the problem as soon as possible after being notified. We reserve the right to be allowed several hours (up to 24 hours) to cure a reported problem. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, internet service, water, pool filtration systems, hot tubs, air conditioning, television or cable service, appliances, etc. It is the Guest’s obligation to report any problems or damage IMMEDIATELY to us.

DOCUMENTATION & INFORMATION

All descriptions and content on our website or otherwise issued by us is written is intended to present a general idea of the services provided by the supplier(s) in question. Not all details of the relevant services can be included on our website. All services shown are subject to availability. If you require any further details, in respect of any accommodation or any other services please contact us.

LIABILITY:

We acting hereunder as agent for accommodations, and assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their House. Transportation (airlines, ferries, charter vessels, rental cars and taxis) is supplied by providers who operate independently of us. We assume no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Furthermore, Guest is responsible for the Villa during occupancy, must lock all windows and doors securely at all times when not on the premises, and must exercise care in securing all personal belongings. The Villa is privately owned. The owner and we reserve the right to refuse service or rentals to anyone at their complete discretion.

NEIGHBORHOOD REGULATIONS

No loud music permitted especially after 10:00 PM.You agree to respect your surroundings and not to disturb or otherwise annoy the occupants of neighbouring properties. You also agree to adhere to any specific noise restrictions in place at the property. We reserve the right to enter the property to investigate concerns relating to the care of the property or to disturbances. Repeated disturbances will cause immediate eviction, and forfeiture of Guest’s entire rent.

PERSONAL BELONGINGS

We do not accept any responsibility or liability for loss of or damage to any of your personal items, belongings or vehicles, however caused. In event of any maintenance work by ourauthorised representative it is required to enter the property during your stay (e.g. to carry out maintenance or cleaning), you are advised to ensure that a member of your party is present; if this is not possible, you have the right to decline services at your discretion but no refunds shall be given by for services not used.

You must ensure that you take all your belongings with you when you depart the property, as we cannot be held responsible for handling lost property nor for any costs incurred in returning such items. Any arrangements for the return of such property must be made by you with a suitable courier firm.

CHILD FRIENDLY PROPERTIES

At child-friendly properties in which the Villa is provided a high chair, cot, stair-gates, baby- monitors, toys or other similar facilities, these are for use at your discretion. We shall not be responsible for any damages that occur as a result of such usage.

LINES & PILLOW COVERS

All of the properties in My Goa Villas invest in good quality bed linens, often at considerable expense. Sun cream, fake tan, waterproof make-up and hair dye can all cause permanent damage to bedding, linen and towels, and we ask that you take care when using these products.

We recommend that if you are planning to use such products during your stay, that you bring your own spare linen to prevent damage to items within the property. If damage / staining does occur and the items cannot be cleaned, a charge may be levied from your Security Deposit to replace these items.

NO SMOKING

Please note that, unless otherwise advised, all of the properties in My Goa Villas are non-smoking. Smoking is allowed in yard, balconies, terraces and open area. Should you fail to adhere to this condition, you may forfeit the Security Deposit.

PETS

Pets are only permitted with prior written consent of the supplier; the supplier may impose an additional accommodation charge where pets are permitted.

Where pets are granted access, they are to be kept under control at all times and are not permitted into bedrooms or on the furniture. You are responsible for any damage caused by pets whether inside or outside the property. If extra cleaning is required because of pets in the property, this may be deducted from the Security Deposit.

We shall not accept responsibility for pet safety. You must not leave pets unsupervised at the property at any time. You will dispose of pet faeces in a clean and sanitary manner.

Where the description of a property states ‘Sorry no pets’ or otherwise restricts pets at the property, we shall not guarantee that pets have not been kept previously at the property.

GOVERNING LAW

In any dispute arising out of this rent agreement, the laws of GOA shall apply and the prevailing party shall recover its costs, expenses and attorney’s fees.


This becomes a binding agreement when you make your rental deposit and constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed above.
